Claim Elements-Overview

In order to pursue a claim against an appraiser, just like a claim against any other professional, the claimant generally must prove four elements:

  1. Duty – The appraiser owed a legal duty to the claimant.
  2. Breach of the Standard of Care – the appraiser violated (fell below) the standards applicable to appraisers in the community.
  3. Causation – As a result of the appraiser’s breach of the standard of care, the claimant suffered damages.
  4. Damages – The damages suffered by the claimant are reasonably ascertainable/quantifiable.
