Although there have been many reported case decisions in Arizona involving professionals (including doctors, architects, contractors, engineers etc.), there are only three decisions involving appraisers. Those three decisions are summarized in our Arizona Court Case pages.
Notably, the third case, Sage v. Blagg Appraisal Co., was handled by Berk & Moskowitz, P.C. Daphne Reaume of Berk & Moskowitz, P.C. argued the case for Sage in the Arizona Court of Appeals.
Sage is the first reported Arizona decision allowing a buyer/borrower to sue an appraiser hired by her lender. That case has significant implications for many potential cases against appraisers. For example, a lender that makes a loan based on an appraiser prepared for the mortgage broker may be able to use the rational in the Sage case to pursue a claim against the appraiser if the appraiser made a mistake or fraudulently inflated the appraisal.
